Terms Excerpt: Payment, Licenses & Returns/Withdrawal
§ 1 Subject of Service
Boothy provides software (licenses) as well as photo booth rental services for events.
§ 2 Digital Content & Exclusion of the Right of Withdrawal
For contracts concerning the provision of digital content not supplied on a physical medium, the right of withdrawal expires once the trader has started performance of the contract, provided the consumer
a) has expressly agreed that the trader may begin performance before the withdrawal period has expired, and
b) has confirmed their awareness that, by giving this consent, they lose their right of withdrawal once performance has begun.

Note: The exclusion only takes effect if an explicit checkbox is implemented at checkout ("I agree that provision begins immediately and that I lose my right of withdrawal as a result"). Without this consent, a blanket exclusion is invalid.
§ 3 Refunds (contractual, beyond statutory withdrawal)
Beyond the statutory right of withdrawal, payments for services already rendered or already begun are non-refundable. Exceptions apply only in cases of demonstrable defects in the software or non-performance of the agreed service, in accordance with statutory warranty rights (§§ 434 et seq. BGB).
§ 4 Warranty Remains Unaffected
The exclusion of voluntary returns does not affect statutory warranty rights (repair, remedial performance, etc.) pursuant to §§ 434 et seq. BGB.
